New general terms and conditions

For EU-deliveries outside Germany and Austria, including EFTA and other countries

General

Our deliveries and services are exclusively governed by these terms and conditions. They form the basis of all transactions and are deemed to be applicable when an order is placed, or a delivery is accepted. Other terms and conditions apply only if accepted by us in writing. Verbal agreements require our written confirmation to become effective.

Quotations, prices, the right to cancel, start of contract

Except for errors and omissions, wholesale prices shown in the applicable price list are valid until revoked and are exclusive of VAT, all quoted amounts are net. An order becomes effective after our confirmation has been registered. Orders confirmations are usually sent by email. After an order is confirmed, there is no entitlement to order cancellation.

Minimum ordner per delivery address, terms and method of dispatch

Our principal terms are “ex works” (incoterms “EXW”) Germany. Thomas Merlo & Partner AG, Dietikon/Switzerland is the billing party. For each delivery to one address, delivery charges are levied. (For details see box below on right side). The company aims to avoid partial consignment but reserves the right to deliver partially if a delay of 3 weeks or more occurs. Thomas Merlo & Partner has its own German VAT-ID (DE256545621).

  • Deliveries within the EU are custom cleared and effected as tax free «Intrastat-shipments», EXW Germany.
  • Deliveries within EFTA are delivered custom cleared, but not VAT-cleared (Incoterms «DAP»), EXW Germany.
  • Deliveries to other countries outside the EU and EFTA are delivered EXW Switzerland.
  • Notwithstanding other arrangements, we reserve the right to choose the carrier.

Minimum order amounts / EORI number

First order: 350.– € or 4 mt Starter Sets (MTCSS)

Orders < 200.– € an extra fee of € 20.– is charged in addition to the parcel fee. A valid VAT-ID and EORI number is required, unless not applicable.

Customers in the EU or EFTA who do not provide a valid VAT-ID, are charged VAT at the prevailing rate of Germany, currently 19 %.

Parcel delivery fees

Group A: 21.– €/parcel
DDP minimum for Group A: net order value ≥ € 400.- €1’000.- if including ladders, paper collectors or other bulky items.

Group B: 23.– €/parcel
DDP minimum for Group B: net order value ≥ € 500.- € 1’200.- if including ladders, paper collectors or other bulky items.

Group C: 29.– €/parcel
DDP minimum for Group C: net order value ≥ € 600.- € 1’400.- if including ladders, paper collectors or other bulky items.

Group A: BE, CZ, DK, NL
Group B: FR, HU, IT, LU, PL, SE, SI
Group C: EE, ES, GB, GR, FI, IE, IS, LT, LV, NO, PT, RO, SK

Terms of payment

Payment in advance Please make use of the SEPA service provided by your bank. Using that service, remittances to Switzerland are normally free of charge: https://www.ecb.europa.eu/paym/integration/retail/sepa/html/index.en.html

Defective goods

Delivered goods must be checked on arrival. Obvious defects must be reported in writing within 5 working days. If no such report is timely received, goods are deemed delivered in good conditions. In case of justified claims, we reserve the right to either supply a free of charge replacement or issue a credit note which ever we deem fit. Defective goods must not be returned or sold without our explicit permission.

Delivery adress for return goods

Authorized returns must only be handled by our designated forwarder. The contact is supplied on request. Our warehouse staff is instructed to reject non-authorized returns. Such will be returned to sender at his risk and cost.

The place of jurisdiction is Zurich/Swiss.
